This guideline tells you what information and data PROSTAFF Schweiz GmbH collects and evaluates, for what purpose this information is used and with whom it is exchanged. When handling your data, PROSTAFF Schweiz GmbH complies with the applicable legislation - in particular the GDPR (DSGVO) and Swiss data protection law. PROSTAFF Schweiz GmbH allows itself the processing of personal data based on the consent of the data subjects. Please note, that PROSTAFF provides this policy in English only as a courtesy. Collection of general information

When you access our website, information of a general nature is automatically collected. This information (server log files) includes the type of web browser, the operating system used, the domain name of your Internet service provider and similar information. This is exclusive information which does not allow any conclusions to be drawn about your person. This information is technically necessary in order to correctly deliver the content you have requested from websites and is mandatory when using the Internet. Anonymous information of this kind is statistically evaluated by us in order to optimize our Internet presence and the technology behind it.

  • Candidates
    Applicants for all jobs advertised or sponsored by PROSTAFF Schweiz GmbH, including temporary and permanent positions as well as part-time positions and freelance work with our customers, and persons who have submitted an unsolicited application to us without applying for a specific job, as well as those persons who are managed and processed by us on the basis of payroll services.
  • Clients
    This category includes, as the term suggests, our customers, clients and other parties for whom PROSTAFF Schweiz GmbH provides services in the course of its business activities.
  • Supplier
    The term refers to partnerships and companies (including sole proprietors) as well as atypical employees such as independent contractors and freelancers who provide services for PROSTAFF Schweiz GmbH. Under certain circumstances, PROSTAFF Schweiz GmbH subcontracts services that the company provides for its customers to external suppliers who provide the services on behalf of PROSTAFF Schweiz GmbH. In this context, suppliers who are individual contractors, freelancers or employees of suppliers are treated as candidates for data protection purposes.

    We use your data for recruitment activities, marketing activities as well as for possible assertion of legal claims.
  • Type of processing 
    Recruitment is the main focus of our work. We process recruitment activities in particular through the following types of data processing:
    • Collection of your data from you and other sources, e.g. LinkedIn, as well as about our marketing activities on job and professional network portals (e.g. jobs.ch, freelance.de)
    • Store (and, if necessary, update) your data in our database so that we can contact you in connection with recruitment
    • Providing recruitment services such as proactive contact (e.g. telephone call, job mailing) for relevant job offers
    • Comparison of data about you with vacancies that we consider suitable
    • Sending your information to customers to apply for jobs or assess your suitability for jobs
    • Allow you to submit your resume, apply online for jobs or receive notifications of jobs we think may be of interest to you
    • Enable you to use the interactive functions of our services
    • Fulfilment of our obligations under mutual contracts
    • Fulfil our obligations under contracts concluded between PROSTAFF Schweiz GmbH and third parties in connection with your recruitment 
    • Conduct customer satisfaction surveys 
    • Review information you have provided using external resources (such as psychometric assessments or skill tests) or requesting information (such as references, qualifications or possible criminal convictions, where appropriate and permitted by local law) 
    • Process your information so that we can send you targeted, relevant promotional materials or other communications that we think may be of interest to you
    We may send you information at regular intervals that we believe may be of interest to you or ask for your help in finding other candidates. In particular, the marketing activities include:
    • Develop and promote other products and services;
    • Personal advertising for our entire spectrum of recruitment services;
    • Send you details of reports, promotions, offers, networking and customer events, and more generally, information about industries that may be of interest to you based on your qualifications.
  • Soft opt-in / opt-out for marketing activities
    For marketing activities we require your consent. Depending on the situation, we will ask you to give them explicitly by "opt-in" or tacitly by "soft opt-in". 
    Soft opt-in consent is a specific type of consent that applies if you have previously dealt with us and we advertise other recruitment services. In the case of "soft opt-in" consent, we consider your consent to be granted as long as you do not withdraw it (so-called "opt-out"). We are obliged to obtain your express consent for other types of e-marketing.
    It is possible that your data may be collected again via public sources in the course of a separate advertising campaign, even if you have unsubscribed from our promotional communications. We try to avoid this, but unfortunately it can still happen. We would ask you to unsubscribe again in these cases.
  • Data processed
    Basic personal data is processed. These include e.g. names, date of birth, contact details, details of education, professional background, nationality or residence status.
    If an employment contract is concluded, we must additionally process further information about you in order to be able to fulfil our obligations towards authorities, insurance companies, etc. and to be able to transfer your fee to you. We ask for information such as address, gender, social security number, marital status, number of children, religious affiliation or bank details. Where appropriate, we may also collect information about your state of health or details of any criminal history.

With data processing, we ensure that the contractual agreements between PROSTAFF Schweiz GmbH and our customers can be properly implemented and a smooth business relationship can be guaranteed.

    • Storing (and, if necessary, updating) your data in our database so that we can contact you in connection with recruitment activities
    • Recording of conversations and meetings so that we can provide specific services for you

  • Data processed
    We collect data about our customers only to a very limited extent. We only need your contact details or the contact details of individual contacts within your organisation (such as names, telephone numbers and e-mail addresses) to ensure a smooth business relationship. We may also store additional information that someone from your organization has voluntarily provided to us.

We need the contact details of the responsible persons within your organisation in order to communicate with you. We also need further information, such as your bank details, so that we can pay for the services you provide (if this is part of the contractual agreements).

    • Collection of your data from you and other sources
    • Storing (and, if necessary, updating) your data in our database
    • Developing appropriate targeted marketing campaigns
  • Data processed
    We collect information about our contacts within your organization, such as names, phone numbers and e-mail addresses. We also collect bank information to make payments to you.

  • Third parties we have engaged to provide services such as verification of references, qualifications and criminal records, where such verification is appropriate and permitted by local law. In the event of data being processed by third parties, PROSTAFF Schweiz GmbH shall remain the responsible body.

If PROSTAFF Schweiz GmbH merges with or is acquired by another company or company in the future (or if there are meaningful discussions about such a possibility), we may pass on your personal data to the (future) new owners of the company or company.

 

Protection of your data

The data that we process is treated confidentially and protected against loss and manipulation as well as against unauthorized access by third parties by means of suitable technical and organizational measures. Your data is stored exclusively on servers in Switzerland.

  • Right of objection
    You may also object to the processing of your data in accordance with Art. 21 GDPR. This right of objection exists in the event of certain reasons arising from your particular situation.
